We are a responsible and transparent business. What you see and read is what you get. If there is something we can make better, please let us know because we are always trying to improve.
That being said, there are a few terms and conditions related to the use of our website and shopping with us, which are listed below.
Overview
DIFFAIR Market is a marketplace for independent designer labels to sell their products. We market the labels and products, facilitate the orders and payments and handle customer enquiries. We are not involved in the design or production of the products, which is solely the responsibility of the respective label. We do not hold stock and do not ship the products; they are shipped directly by the labels.
Account creation
By creating an account with us, you agree to provide us with your personal details, which will be treated confidentially in accordance with our Privacy Policy. You will automatically be subscribed to our newsletter and special offers mailing lists, however you can unsubscribe at any time in your account or directly from an email.
There is one customer account for all DIFFAIR services, be it the DIFFAIR Market or the private online stores powered by DIFFAIR. From your account you can access all your orders from DIFFAIR Market as well as all private stores powered by DIFFAIR. The newsletter subscriptions are only for DIFFAIR Market however.
Email validation
You are required to validate your email address before you will be allowed to place an order or create an account.
Newsletter
By signing up to our newsletter, you agree to provide us with your personal details, which will be treated confidentially in accordance with our Privacy Policy. You will be subscribed to our newsletter mailing list and additionally subscribed to our special offers mailing lists. You can unsubscribe from each of these lists at any time in your account or directly from an email.
Products
All products and colour variants have at least one photo, a description and some additional information. The colours indicated are indicative only and may vary due to differences in display settings or hardware. Please consider the photo, the colour name, the colour box and any colour information in the description to determine the colour of the garment. Slight variations in colour are not considered a breach of warranty.
If there are any differences between the product description and other information (such as delivery time, refund policy, colours or materials), then the information given in the product description shall be considered for warranty purposes.
Placing an order
By placing an order, you agree to pay the amount shown on the order. Your order will not be confirmed and no products will be shipped until full payment is received. You also agree to provide us with your personal details, which will be treated confidentially in accordance with our Privacy Policy.
Payment methods
You can pay with any of the payments methods we accept. Currently we accept payments by credit cards (Visa, MasterCard and American Express) and pre-payments via invoice.
Delivery to Switzerland and Liechtenstein
The shipping cost and expected delivery time are set for each product by the respective label and are shown on the product page. Each label has a maximum shipping cost per order and may specify an order amount to qualify for free shipping. When multiple items from the same label are purchased in a single order, any reduction in shipping is automatically calculated as you add items to your basket. If you miss out on free shipping by a smaller amount than the current shipping cost, then only this amount will be charged for shipping.
The stated delivery times are indicative only and are not legally binding. If delivery cannot be made within the indicated time, you will be notified and given a new delivery time. For the purpose of your statutory rights, the legally binding delivery term shall be considered twice the time of the original delivery term or the updated delivery term if this is later.
International delivery
If a label provides shipping to your country, the shipping cost will be shown on the product page. Typically, international shipping costs are a flat rate per label per order. The delivery time shown for each product is indicative of when the product might leave Switzerland. If an order cannot be shipped within the indicated time, you will be notified and given a new delivery time. For the purpose of your statutory rights, the legally binding term for the item to be shipped shall be considered twice the time of the original delivery term or the updated delivery term if this is later. Once shipped, the label and DIFFAIR Market are not liable for delays in international delivery.
Returns and refunds
The return policy for each product is shown on the relevant product page. Labels can choose their own return period and one of the following return policies:
⬤Free return shipping: the label provides a return-shipping label with the product or once the return request is processed. For international orders, a return-shipping label is not provided and you shall bear the cost of return delivery
⬤Standard: you bear the cost of returning the article by your chosen method
⬤Returns accepted for a fee: you will be asked to pay a small handling and restocking fee as specified on the product page and will be provided with a return-shipping label. For international orders, you may be required to pay a higher fee
⬤No returns: returns are not accepted except under a warranty claim
Returns must be requested exclusively through our online portal and must be within the allowed return period. The deadline for requesting returns is the stated number of calendar days after receiving the item or items in question. You will be deemed to have received the items two business days after the shipment confirmation from the label, unless you can prove otherwise. In the latter case the possibility to upload proof through our online form is provided.
Returned items must be in original condition and not be worn or used (except to try on for size). They must be sent directly back to the label and must arrive within 7 days of the return deadline.
Once your return has been accepted by the label, a refund of the product price, but not the shipping cost, will be made within 14 days. Late returns or goods not in original condition may not be accepted and may be sent back to you. In this case no refund will be provided.
Returns for products in the underwear and swimwear categories will generally not be accepted. If the label does allow returns, trying on for size is to be avoided or only done on top of your own clothing.
Warranty
Together with the individual labels, we make every effort to show and describe the products as accurately as possible. All products are new unless specifically stated in the product description. If you receive a product that is not new, is damaged or is significantly different to its depiction on this site, you can return it for a full refund if notified within 7 days of receiving the product. The date you receive the item is calculated as for returns, as is the deadline for return delivery. Warranty claims are to be made via the same online portal as for returns.
The statutory warranty applies for all products except for artworks. The statutory warranty is excluded for all products listed in the art category.
Changes to these terms
We reserve the right to make modifications to these terms and conditions at any time. Previous versions of these terms are made available on our website.
